These Terms of Service ("Terms") are an agreement between you and Home Agent LLC ("HomeAgent," "we," "us," or "our"). They govern your use of the HomeAgent mobile app, our website at yourhomeagent.ai, the HomeRecord and HomeManager plans, and related services (together, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.
The short version
HomeRecord is free. HomeManager is a paid membership that renews automatically until you cancel. You can cancel any time in the app.
AI guidance is informational. It can be wrong, and it isn't a substitute for a licensed professional.
HomeAgent is not an emergency service. For gas, fire, flooding, sparking, or carbon monoxide, get to safety and call 911 and your utility.
Repairs are done by independent service professionals, and you'll get a quote before any paid work is booked.
HomeManager is available only for homes in Nassau and Suffolk counties, New York.
01Who can use HomeAgent
You must be at least 18 years old, able to form a binding contract, and located in the United States to use the Services. To book a service call or join HomeManager, you must own the home or be authorized by its owner to arrange work there.
02Your account
Give us accurate information and keep it up to date. You're responsible for keeping your sign-in details secure and for activity on your account. Tell us right away at support@yourhomeagent.ai if you think someone has used your account without permission. Each account is for one person. If you invite household members, they can see and contribute to your shared home record.
03The Services
HomeRecord (free)
HomeRecord lets you keep a record of your home and its appliances and systems, read appliance labels, receive maintenance suggestions and reminders, get alerts about product safety recalls, and get AI guidance when something needs attention. HomeRecord is available anywhere in the United States.
HomeManager (paid membership)
HomeManager adds a coordinator on our team who arranges repairs, two complimentary service calls each membership year, and member rates on additional service calls and repairs. What's included is shown in the app before you subscribe.
Service area
HomeManager and in-person service calls are available only for homes in Nassau and Suffolk counties, New York, based on the service address you give us. We may decline a HomeManager purchase for an address outside that area.
Changes to the Services
We're continually improving HomeAgent, so features may change. If we discontinue HomeManager, we'll refund the unused portion of any membership you've prepaid.
04HomeManager membership and billing
Your HomeManager membership renews automatically at the end of each billing period, monthly or annual depending on the plan you choose, and we'll charge your payment method the price then in effect until you cancel. You can cancel any time in the app under Settings, then Subscription.
Price. The price and billing period are shown in the app before you subscribe. Applicable taxes may be added.
Payment. Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method for each billing period until you cancel. Keep your payment method current. If a payment fails, we may retry it and may pause HomeManager benefits until it's resolved.
Cancelling. Cancellation takes effect at the end of your current billing period. You keep HomeManager until then, and you won't be charged again.
Refunds. Except where required by law or stated in these Terms, payments are non-refundable, and we don't give refunds or credits for partial billing periods or unused service calls.
Deleting your account. Deleting your account cancels HomeManager immediately, and any remaining paid time ends without a refund. To keep your benefits through the end of the period you've paid for, cancel first and delete your account later.
Price changes. We'll tell you at least 30 days before a price change applies to you. The new price takes effect at your next renewal, and you can cancel before then.
Annual reminders. If you're on an annual plan, we'll remind you before your membership renews.
Payments aren't handled by Apple or Google. HomeManager is billed by HomeAgent through Stripe, not through the App Store or Google Play, so Apple and Google aren't responsible for membership charges or refunds.
Complimentary service calls
HomeManager includes two complimentary service calls per membership year, each with up to two hours of a service professional's time, for tasks on our service-call list shown in the app.
Your membership year starts on the date your membership begins. Unused service calls don't roll over to the next year, have no cash value, and end when your membership ends.
Parts and materials aren't included and are quoted separately.
Additional service calls and repairs are billed at member rates and quoted before they're booked.
05AI guidance and safety
HomeAgent uses artificial intelligence to read labels, organize your home record, suggest maintenance, and draft guidance. Please use it with that in mind.
It's informational, not professional advice. AI guidance is not the advice of a licensed contractor, electrician, plumber, engineer, or inspector.
It can be wrong. Guidance, diagnoses, maintenance suggestions, and recall matches may be inaccurate, incomplete, or wrong for your situation. They depend on the information and photos you provide.
You decide what to do. Use your own judgment, follow the manufacturer's instructions and local codes, and stop if you're unsure. Have a licensed professional confirm anything beyond simple checks.
Don't attempt hazardous work based on the app. That includes work on gas lines or appliances, electrical panels or wiring, structural elements, roofs, or anything that requires a license or permit.
HomeAgent is not an emergency service and does not monitor your home. If you smell gas, see smoke, fire, or sparking, have active flooding, or hear a carbon monoxide alarm, get to safety first. Then call 911 and your utility company.
06Service calls, professionals, and text messages
Independent professionals. Service work is performed by independent businesses, not by HomeAgent employees. Each professional is responsible for its work, including required licenses, permits, and compliance with building codes.
Quotes first. You'll receive a quote before any paid work is booked, and nothing paid is booked without your approval. If the job turns out to be different from what was described, the professional will get your approval before any change in price.
Your part. Provide safe access to the work area, have an adult present or make other arrangements with us, secure pets, and tell us about hazards you know of, such as mold, asbestos, or damaged wiring.
Rescheduling and cancelling. Please reschedule or cancel at least 24 hours before a visit. A late cancellation or missed visit may count as a used service call or carry a fee, which we'll tell you about when you book.
If something isn't right. Tell us within 30 days of the visit and we'll work with the professional to address it.
Text messages
HomeAgent service texts are text messages from Home Agent LLC, operating as HomeAgent, about the service requests you start in the app: scheduling and confirming visits, changes and cancellations, technician arrival updates, and conversations with a HomeAgent coordinator about your job. We don't send marketing texts.
You'll only receive texts if you opt in, by entering your mobile number and checking the text message box in the app. Opting in is not required to use HomeAgent or to buy service.
Message frequency varies with your service requests.
Reply STOP to opt out at any time. We'll send one message confirming you've been unsubscribed, and then no further texts. Reply START to opt back in.
Carriers are not liable for delayed or undelivered messages.
How we handle your mobile number and text consent is described in our Privacy Policy.
07Your content
You own the information, photos, and messages you add to HomeAgent ("your content"). You give us permission to host, store, process, and share your content as needed to provide and improve the Services, as described in our Privacy Policy, including with our AI provider and with the service professional handling your job. You confirm you have the right to share your content, and you agree not to upload other people's personal information beyond what's needed to use the Services. We may use de-identified and aggregated information to improve HomeAgent.
08Acceptable use
Don't use the Services to do anything unlawful, give false information, or harass our team or service professionals. Don't copy, scrape, reverse engineer, or interfere with the Services, try to get around their security, access another person's account, upload malicious code, or use the Services to build a competing product.
09Our app and intellectual property
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the HomeAgent app on devices you own or control, for your personal, non-commercial use, under these Terms. HomeAgent and its licensors own the Services, including the software, design, and content we provide, and all related rights. If you send us feedback or ideas, we may use them without any obligation to you.
10Third-party services
Some features rely on other companies, such as Stripe for payments and Apple or Google for sign-in. Their terms apply when you use them, and we aren't responsible for their services. Links to outside websites, such as manufacturer manuals, are provided for convenience.
11Ending your use
You can stop using the Services and delete your account at any time. We may suspend or end your access if you break these Terms, if your use creates risk for others, or if we're required to by law. If we end your HomeManager membership for a reason other than your breach of these Terms, we'll refund the unused portion you've prepaid. Sections that by their nature should continue after your account ends, including those on your content, disclaimers, limitation of liability, indemnity, and disputes, will continue.
12Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available." Except as expressly stated in these Terms, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Services will be uninterrupted or error-free, or that AI guidance will be accurate. Some states don't allow these disclaimers, so some of them may not apply to you.
13Limitation of liability
To the fullest extent permitted by law, HomeAgent will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from or related to the Services. This includes damage resulting from your reliance on AI guidance or from repairs you choose to make yourself.
To the fullest extent permitted by law, our total liability for any claim arising from or related to the Services is limited to the greater of the amount you paid us in the 12 months before the claim arose or $100.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or anything else that cannot be limited under applicable law.
14Indemnity
To the extent permitted by law, you agree to defend and indemnify HomeAgent against third-party claims arising from your violation of these Terms, your content, or your misuse of the Services.
15Disputes and governing law
If you have a concern, contact us first at support@yourhomeagent.ai. Most issues can be resolved quickly that way, and we both agree to try in good faith for 30 days before starting a formal proceeding.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be heard in the state courts located in Nassau County, New York, or the federal courts for the Eastern District of New York, and you and HomeAgent consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead.
16App Store terms
If you downloaded the HomeAgent app from Apple's App Store, the following also applies:
Agreement. These Terms are between you and HomeAgent only, not Apple. HomeAgent, not Apple, is solely responsible for the app and its content.
Scope of license. Your license to use the app is limited to a non-transferable license to use it on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
Maintenance and support. HomeAgent is solely responsible for providing maintenance and support for the app. Apple has no obligation to do so.
Warranty. HomeAgent is solely responsible for any product warranties, to the extent they are not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
Product claims. HomeAgent, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
Intellectual property claims. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, HomeAgent, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Developer contact. Questions, complaints, or claims about the app should be directed to HomeAgent using the contact details in section 19.
Third-party terms. You must comply with any third-party terms that apply when using the app, such as your wireless data service agreement.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
If you downloaded the app from Google Play, Google Play's terms also apply, and Google is not responsible for the app.
17Changes to these Terms
We may update these Terms from time to time. If a change is material, we'll notify you in the app or by email at least 14 days before it takes effect, unless the change is required by law or only adds new features. If you keep using the Services after a change takes effect, you accept the updated Terms. If you don't agree, stop using the Services and cancel any membership.
18General
These Terms, our Privacy Policy, and any terms shown to you when you make a purchase are the entire agreement between you and HomeAgent about the Services. If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition, or sale of assets. We aren't responsible for delays caused by events beyond our reasonable control. You agree that we may send you notices and other communications electronically, including by email and in the app.
